Συναδέλφισες-συνάδελφοι, έχουν πραγματοποιηθεί 2 συναντήσεις της διαπραγματευτικής ομάδας της Ομοσπονδίας μας, με τους εργοδότες του κλάδου και παρά τη δήθεν συμφωνία που εκφράζουν ότι πρέπει να υπογραφεί νέα ΣΣΕ, κωλυσιεργούν αποδεικνύοντας ότι δεν ενδιαφέρονται για τα προβλήματα και τα αιτήματα μας, αλλά μόνο για την κερδοφορία τους.

Αποτελεί μεγάλη πρόκληση να μιλούν για <<δύσκολους καιρούς>> αυτοί που έχουν θησαυρίσει όλα τα προηγούμενα χρόνια από τις πλάτες των εργαζομένων με τους χαμηλούς μισθούς, την εντατικοποίηση, τις ελαστικές μορφές εργασίας, τα ανύπαρκτα μέτρα υγιεινής και ασφάλειας, στους χώρους δουλειάς.

Η μόνη αλήθεια είναι ότι οι βιομήχανοι αυξάνουν από χρόνο σε χρόνο σε δυσθεώρητα ύψη την κερδοφορία τους, σε αντίθεση με τους εργαζόμενους που αγωνιούμε καθημερινά για ένα κομμάτι ψωμί, μη μας κόψουν το ρεύμα, μα μας ξεσπιτώσουν.

Speech of Pambis Kyritsis, General Secretary of WFTU at the National Congress of PAME

Dear colleagues,
On behalf of the 105 million members organized in WFTU’s hundreds of TUIs in 133 countries from all over the world, allow me to convey our warmest, militant greetings.

Your congress is taking place at a time when the economic crises of capitalism are consecutive. The pandemic has not only dramatically deepened economic and social inequalities, but it has also been used as an excuse for new attacks on the workers’ democratic rights and trade union freedoms.

At the same time, imperialist wars and interventions relentlessly go on. The leaders of USA, EU and NATO, shamelessly invoke International Law and the defense of freedom, when they speak of the Russian invasion of Ukraine.

Those who are responsible for countless invasions and interventions, seem to be unaware that they are primarily responsible for the militarization of international relations, as they insist on maintaining and expanding NATO within the context of a New World Order. They pretend not to understand that in Ukraine, as was the case elsewhere as well, fascists and warmongers were encouraged and revived, in order to serve their own geopolitical goals.

But we know that world peace cannot be protected through militarization or through the patronage of all kinds of extreme right-wing nationalist and fascist ideologies. World peace cannot be based on sanctions and economic wars. Those who, as a matter of principle, stand for peace and freedom, fight for the dissolution of NATO and all military coalitions, the abolition of nuclear weapons and for respecting the independence and sovereignty of all countries, rather than only those which align with, and serve the interests of, the United States and their allies.

With the slogan “For the satisfaction of our contemporary needs. Against imperialist-capitalist barbarity”, WFTU’s 18th Congress was held on May 6-8 in Rome. This historic Congress reaffirmed the anti- imperialist and anti-fascist character of WFTU and its commitment to the struggle for the liberation of the working class from the shackles of capitalism. The Congress has also set guidelines for the class-oriented trade union movement’s daily struggles, so that the modern needs of the workers can be met.

With its key priorities being:
– Fighting against labor deregulation and defending collective bargaining agreements.
– Repelling the attack against democratic and trade union freedoms.
– Fighting against all forms of discrimination based on race, color, religion or gender.
– Struggling to protect workers’ incomes against high prices and inflation.
– Fighting for a dignified life for pensioners.
– Fighting for a welfare state and public services.
– Fighting for public health systems and free, quality healthcare for all those who need it.
– Resisting racism and xenophobia.
– Fighting for the unity of workers based on their class-oriented goals.

Speech of trade unionist Vincent Leuze, from Baden-Württemberg in southern Germany at the National Congress of PAME

Colleagues, comrades,
1.
We thank you for the invitation! Especially in times like this, workers need to connect internationally and take action in solidarity, we thank PAME for this opportunity!
We are trade unionists from Baden-Württemberg in southern Germany.
We are both members of IG-Metall, the largest single trade union in the world.
We also work in the umbrella organization of German trade unions, de DGB.

This organization and its structures are strongly influenced by the lessons of German fascism. In concrete terms, this means that we are organized in one unified union, according tot he principle one industry, one union. Regardless of political orientation.
The unions are in turn organized in a common umbrella organization, the DGB.
The practice of the DGB consists primarily of rough political directives and impulses, the direct work in and with the workers is done by the unions themselves.
These lessons from the period of German fascism, these lessons from the damage that German fascism inflicted on the movement and the organizations of our class are necessary. Nevertheless, this  structurization of the unions brings difficulties.

The main staff and functional apparatus of the trade unions and above all the leadership of the trade unions is firmly in the hands of social democracy. This is comparable to the conditions in an openly social-democratic union.
Communists and leftists regularly experience repression from the social democratic leadership.
The practice of the unions, shaped by the hegemony of social democracy, runs directly counter to the interests of the members and our class in general.
Instead of fighting for higher wages, the social democrats rely on their often praised partnership with the capitalist.
In the pandemic years, zero wage increases were agreed upon again and again.
There was a Bosch branch in our region with 300 employees that was to be closed, 90% of the workforce was organized in our union and called on it to wage the struggle aggressively and go on strike.
Responsible officials actively prevented this. German labor law has effiently disempowered works councils, and only the union apparatus can call for a strike.

We are actively working against this paternalism and obstruction of our class by social democracy.
Communists and parts of the workers of the Bosch Branch marched to the house of the local manager. At an event of the Social Democratic leadership of our Union, to mark the arrival of the new government, we organized a class-conscious section under the slogan “Don’t trust this government – build on your own strength”. We must not ask the government for help. Only our class itself can assert its interests in the struggle against capital.
We joined the struggle of a left Workers group in the Mercedes factory in Stuttgart, in preventing the reduction of 4000 jobs while the union stopped all direct actions on the streets because of the pandemic. During working hours, the workers occupied a parking garage near the factoryand held a rally there.
This action was organized and supported by the local unionists in the factory, and the union leadership was informed about it shortly before the action started. In fact, this was a wildcat strike without the consent of the union leadership.
The hegemony of Social Democracy in the main union apparatus can only be broken from the workplaces with such offensive actions. And by making the class antagonism tangible day by day in the workplace.
5.
The attacks of capital continue, the rate of inflation is rising enormously and corporations are raising prices for rent, food and fuel.
With the class-conscious parts of the unions , we respond to this with actions and joint organizing without the knowledge of the leadership of the unions.
We created pressure on trade union leadership and enforced a rally against the rising inflation with unionists from different industries.
The speakers called for a militant struggle for pay raises in the face of the worsening and overlapping of crises and formulated a socialist perspective instead of sinking into the chaos of the market.
The demonstration on first of May 1, officaly organized by the leadership of the DGB, is now in the hands of the class-conscious parts of the union.
This gives us hope, and we continue a common exchange about our class response to inflation and price increases, and we will push forward with joint organizing.

Since the Russian attack on Ukraine, Germany rushes to militarization. The government is pouring tens of billions into the army and armaments in a very short time and without debate.
But it is not only the bourgeoisie that is driving the rearmament. So called Leftists and trade unionists are also abandoning positions that have been the basis of progressive politics for years: fighting imperialist wars and militarization. They allow themselves to be drawn to the side of the Western imperialists in the struggle of the reactionary power blocs, instead of saying: this is not our war, the working class can only lose here.
The struggle for pay raises in the chemical industry has been suspended by the union until October. The Ukraine war, high energy prices and rising inflation are cited as reasons for this action.
For us workers, this will lead to a situation in which we have to keep quiet and accept that in real terms we will get less and less from our wages. This leads to the disarmament of our class. While our class opponent enriches himself!

We thank you for your attention, but much more we thank you for the possibility of cooperation!
Connecting class-conscious unionists is now more important than ever.
To back down now because of an “external enemy” only helps the capitalists. Inflation is not a force of nature, but the result of the anarchy of the market economy. We cannot face its consequences together with our exploiters – we have to fight for a solution for our class by ourselves. This also means to stand up inside the trade union for real wage demands and for our own militant enforcement of them.
In these struggles we create class consciousness and we have to develop this consciousness and organize ourselves.
For the interests of our class, for the historical role of our class.

Intervention UD CGT 94 à coférence du PAME

Chers camarades du PanergatikoAgonistikoMetopo, je vous transmets le salut fraternel de l’Union départementale des syndicats CGT du Val-de-Marne, en France, qui vous remerciepour votre invitation et vous félicite pour l’organisation d’un tel évènement.

C’est un honneur et une fierté pour nous de pouvoir participer à cette rencontre internationaliste qui prône un syndicalisme de masse et de classe à l’échelle de la planète. Elle contribuera, à l’aune de votre congrès, contribuera, c’est sûr, à l’enrichissement et l’élargissement de nos luttes.

Chers camarades, beaucoup de travailleuses et travailleurspartout dans lemonde, sontaujourd’hui tentés par les idées nauséabondes de la haine de l’autre. Beaucoup se trompent de colère en se laissant manipuler par la stratégie des puissants, responsables de leurs malheurs,qui met en concurrence les travailleurs entre eux. Attachés à l’internationalisme et profondément antis militaristes, nous ne pouvons accepter que la lutte pour l’émancipation des classes laborieuses ne se fasseque dans un seul coin de la planète. C’est bien toutes et tous ensemble que nous réussirons à mettre en place un projet de société démocratique, socialet universel.

Notre union départementale rassemble 13 600 syndiqués autour de 16 unions locales.

Nous avons subi, comme partout en France une baisse de la syndicalisation. Les fermetures de sites industriels, la stratégie économique de filiale, de sous-traitance ou delocation-gérance, de création de nouveaux statuts précarisés de travailleurs, les politiques d’austérité appliquées au service public, ontéparpillé les unités de travail et fragilisé l’organisation collective des salariés. Les pratiques discriminatoires des patrons face aux militants de la CGT,ont favorisé le développement d’un syndicalisme d’accompagnement, au détriment du rapport de forces.

Enfin l’idéologie du « self-made man » aindividualisé le destin desouvrières et ouvriers et détourné toujours plus les profits au détriment du bien-être des vrais créateurs de richesses.

Le rôle de notre union départementale est de leur donner les outils pour leur permettre de sortir de l’isolement dans lequel la société libérale et individualiste les a plongés.

Alors que la pandémie du au COVID19 faisait rage et tuait des millions de personnes dans le monde, la mise à l’arrêt de l’économie n’a malheureusement pas empêché les grandes puissances financières et industrielles d’augmenter leurs profits avec l’argent public, l’argent de nos impôts, mais elle a ouvert les yeux des travailleuses et des travailleurs.

Les salariés des services publics de proximité, de l’hôpital, de la grande distribution, des services à la personne ou du nettoyage, ont dû assurer la survie de la population en prenant tous les risques, sans que leurs patrons ne soient capables de les protéger. Ils ont enfin compris qu’ils ne pouvaient compter que sur eux-mêmes.

Le confinement nous a contraint à changer nos pratiques syndicales.

Nous avons pu accompagner les salariésavec la mise en place d’une permanence téléphonique gratuite pour les aider à faire valoir leurs droits. Les délégués syndicauxont pu se rendre dans les établissements pour contraindre les employeurs à mettre en place des mesures de protection.

Nous avons interpellé les pouvoirs publics sur les non-respects du Code du Travail.

Nous avons porté des campagnes d’information contre l’obligation du passe sanitaire, pour la gratuité des vaccins et la levée des brevets.

Chaque jour des salariés dans nos entreprises, nos établissements et administrations sont aujourd’hui en lutte. Dans les hôpitaux, les établissements d’hébergement pour personnes âgées dépendantes, les écoles, les aéroports, les commerces pour exiger à chaque fois les mêmes revendications, l’augmentation des salaires, l’amélioration des conditions de travail

L’UD CGT 94 portons ce combat sur tous les fronts :

D’abord en accompagnant le rapport de force que les salariés créent dans leurs entreprises pour leurs salaires et de meilleures conditions de travail, en les soutenant par la collecte de dons et la mise en place decaisses de grève ;

Mais aussi par la formation syndicale pour donner les clés de compréhension de la société capitaliste aux jeunes syndiqués et partager notre démarche revendicative ;

Par des permanences juridiques, par des occupations de sites pour contraindre les patrons qui exploitent les travailleurs sans papier à les faire régulariser.

Notre force, c’est notre nombre et le caractère indispensable de nos métiers dans une société que la grande bourgeoisie a construit à son service. La prise de conscience de travailleuses et travailleurs, que nos vies valent mieux que leurs profits, grandit. Beaucoup de salariés se tournent vers notre syndicalisme de lutte et rejettent le fatalisme.

Enfin, dimanche auront lieu des élections législatives dans notre pays. Dans notre département, plusieurs candidats sont issus du monde du travail comme Rachel, femme de ménage pourla chaine hotellière IBIS qui a porté, avec ses camarades, une lutte victorieuse pendant presque 2 ans, dont 8 mois de grève, ou Julien militant CGT infatigable pour la défense des services publics. Ils sont aujourd’hui à la porte de l’Assemblée nationale. C’est aussi en s’appropriant le pouvoir politique que notre classe pourra faire plier définitivement le patronat et la grande bourgeoisie, pour enfin renverser la table.

Vive la lutte, vive l’internationalisme, vive la CGT et zito to PAME!

Comrade General Secretary George Perros

On behalf of the WFTU European Office I bring greetings to the Congress of PAME, the combative Greek class oriented trade union that is a pillar of the WFTU in Europe and worldwide and to which I am linked by deep and sincere friendship.

The struggles that PAME unceasingly puts up in every sector of work and society are a stimulus for all class-oriented trade unions in Europe and the world and point the way of militant struggle to all workers of the world

Dear comrades

The situation for the class-oriented trade union movement in Europe today is complex and difficult and requires a strengthening of relations between the organisations that have chosen the horizon of class struggle and thus the FSM.

In the last two years we have had to go through a pandemic health crisis, still ongoing, which has hit the workers and popular strata hard, and the war which for the second time sees inter-imperialist competition taking place on European territory. A war that brings death and destruction and prefigures a new geopolitical and economic order with a new division into blocs and the isolation of China, which are the real targets of the USA, the EU and NATO.

In these two dramatic years, the silence of the yellow unions has been deafening.

No opposition to the attempt by the EU and the bourgeois governments to use the pandemic to further shrink democratic spaces and make the workers and peoples pay for the choices to dismantle and privatise public health, no initiative to oppose war, NATO, and the shifting of huge resources to military spending.

Only the class organisations have maintained, despite enormous difficulties, their militant spirit by organising strikes, mobilisations, blockades in every sector to oppose the management of the pandemic, the support for the war by European governments that is producing a crisis in the supply of raw materials that has contributed to a sharp rise in inflation, prevent the use of the crisis by the bosses to strengthen exploitation and the attack on wages and social protections.

Dear comrades,

The 18th World Congress of the FSM in Rome strengthened the prospects of the international class movement, gave impetus and enthusiasm to the delegates of the combative organisations from all over the world, pointing the way to militant and determined struggle with the aim of fighting and defeating the capitalist mode of production, of broadening the anti-imperialist front, of fostering the growth and development of our presence in every country, in every workplace.

In the coming weeks, the European Office  will start a discussion with all member organisations to adapt class union action in Europe, establish a common work plan and better organise the coordination of struggles and political discussion.

I am sure that in this work we will have the valuable cooperation of PAME and its leaders and the support of the Secretariat and the whole world trade union federation.

ΠΑΜΕ Τύπου και ΜΜΕ : Κανένα λαϊκό σπίτι στα χέρια τραπεζίτη

            Το ΠΑΜΕ Τύπου και ΜΜΕ εκφράζει την αλληλεγγύη του στη συνάδελφο Ιωάννα Κολοβού, που βρίσκεται σε κίνδυνο άμεσης έξωσης, λόγω αδυναμίας αποπληρωμής ενός «δανείου» ύψους 15.000 ευρώ.

            Η χαμηλοσυνταξιούχος, επικεφαλής μονογονεϊκής οικογένειας συνάδελφος, από ανάγκη μπλέχτηκε στα δίχτυα των αδιαφανών όρων του τραπεζικού δανεισμού της Εθνικής Τράπεζας, πληρώνοντας για χρόνια ποσά συνολικά κατά πολύ μεγαλύτερα από το αρχικό της χρέος.

            Καμμιά καταγγελία δεν είναι αρκετή, καμμιά έκκληση στα φιλάνθρωπα αισθήματα δεν μπορεί να βάλει φρένο στις παρασιτικές λειτουργίες του χρηματιστικού κεφαλαίου που λειτουργεί μέσα στο καπιταλιστικό σύστημα σαν μοχλός συγκέντρωσης και αναδιανομής πλούτου υπέρ των επιχειρηματικών ομίλων, τσακίζοντας αδιάκριτα τους εργαζόμενους, τα φτωχά λαϊκά στρώματα, τα πιο αδύναμα μέλη της κοινωνίας.

            Αλλωστε τις αδηφάγες ορέξεις των τραπεζών για να τσακίζουν τα λαϊκά νοικοκυριά, τις πυροδοτεί η πολιτική όλων των ως τώρα κυβερνήσεων, ΝΔ, ΣΥΡΙΖΑ, ΠΑΣΟΚ, που ενίσχυσαν και ενισχύουν το νομικό οπλοστάσιο των κατασχέσεων και των πλειστηριασμών για να αυγαταίνει το κεφάλαιο των τραπεζών τα κέρδη του και να ενισχύει τους επιχειρηματικούς ομίλους.

            Μπροστά σ’αυτή την πραγματικότητα, η πλειοψηφία του ΔΣ της ΕΣΗΕΑ, αλλά και των άλλων Ενώσεων των εργαζομένων στα ΜΜΕ ουσιαστικά αδρανούν. Αντί να καλέσουν σε αγωνιστική κινητοποίηση καταδίκης αυτής της πολιτικής και υπεράσπισης από τις κατασχέσεις και τους πλειστηριασμούς σπιτιών των εργαζομένων, πασχίζουν να δείξουν την ευαισθησία τους με αναποτελεσματικά μέσα στα όρια της φιλανθρωπίας.

            Τώρα είναι η ώρα της οργανωμένης εργατικής και λαϊκής παρέμβασης και δράσης για την υπεράσπιση από κατάσχεση και πλειστηριασμό στο σπίτι της συναδέλφισσας Ιωάννας Κολοβού, αλλά και κάθε σπιτιού που κινδυνεύει, οποιασδήποτε λαϊκής οικογένειας.

            Σε αυτό το καθήκον πρέπει να ανταποκριθούν τα Δ.Σ των Ενώσεων και πρώτα-πρώτα της ΕΣΗΕΑ.

            Καλούμε τους συναδέλφους την Παρασκευή 1 Ιούλη ώρα 9.00 π.μ. σε συγκέντρωση αλληλεγγύης και παρέμβασης ενάντια στην κατάσχεση του σπιτιού της συναδέλφισσας έξω από το σπίτι της, Αβύδου 146-148 Ιλίσια.

Σωματείο Εργαζομένων στο Νοσοκομείο Θριασίου :30 Ιούνη συγκέντρωση διαμαρτυρίας για συνεχιζόμενες επιθέσεις σε βάρος υγειονομικών

Να ληφθούν άμεσα μέτρα  για την προστασία της ασφάλειας και τη νομική κάλυψη των υγειονομικών  που δέχονται επίθεση στο χώρο εργασίας τους

ΠΕΜΠΤΗ 30 ΙΟΥΝΙΟΥ στη 1 μ.μ.

Συγκέντρωση στην είσοδο του νοσοκομείου

Το πρόσφατο (στις 24 Ιουνίου 2022) απαράδεκτο περιστατικό επίθεσης γνωστού «επισκέπτη» και σοβαρού τραυματισμού δύο εργαζομένων και ενός ασθενή στο ΘΡΙΑΣΙΟ νοσοκομείο επιβεβαιώνει την ανάγκη για ενίσχυση της φύλαξης του νοσοκομείου και εξασφάλιση, με κρατική ευθύνη,  πλήρους νομικής κάλυψης και στήριξης στους υγειονομικούς, που δέχονται επίθεση κατά τη διάρκεια της εργασίας τους.

Χαρακτηριστικό είναι ότι ο συγκεκριμένος «επισκέπτης» (που σε βάρος του εκκρεμεί σε βάρος του καταδίκη, με αναστολή, για προηγούμενο σοβαρό τραυματισμό γιατρού), εδώ και χρόνια, επιτίθεται και τραυματίζει εργαζόμενους του ΘΡΙΑΣΙΟΥ νοσοκομείου.

Σε προηγούμενη «επίσκεψη» του στο ΘΡΙΑΣΙΟ νοσοκομείο,(στις 24 Δεκεμβρίου 2021, είχε επιτεθεί σε τρεις γιατρούς του ΘΡΙΑΣΙΟΥ  νοσοκομείου, με αποτέλεσμα το τραυματισμό, στο πρόσωπο, της μιας από αυτούς.

Οι επιθέσεις αυτές δεν είναι μεμονωμένες. Προστίθενται στα συνεχώς αυξανόμενα περιστατικά προπηλακισμών, επιθέσεων, ακόμα και σοβαρών τραυματισμών, σε βάρος εργαζομένων στις δημόσιες μονάδες υγείας και το ΕΚΑΒ, κατά τη διάρκεια εκτέλεσης των καθηκόντων τους. Χαρακτηριστικά αναφέρουμε:

  • τον προπηλακισμό γιατρών της Νευροχειρουργικής κλινικής από συγγενή νοσηλευόμενης ασθενούς, στις 23 Ιουνίου 2022, ο οποίος απειλούσε «ότι θα παρει όπλο και θα τους καθαρίσει»
  • την επίθεση και τραυματισμό τραυματιοφορέα από συγγενή νοσηλευόμενης ασθενούς, καθώς και την επίθεση και τραυματισμό φύλακα από αστυνομικό σε υπηρεσία!!!, στις 17 Ιουνίου 2021
  • την επίθεση και τραυματισμό ειδικευόμενης παιδιάτρου από συνοδό ασθενή, στις 5 Ιουνίου 2022
  • τις συχνές επιθέσεις σε βάρος συναδέλφων στο ΤΕΠ, όπως στις 20 Ιανουαρίου 2022,
  • την «εισβολή» ομάδας αυτοαποκαλούμενων «Θεματοφυλάκων του Συντάγματος», στις 28 Αυγούστου 2021, και τον προπηλακισμό συναδέλφων στην Πνευμονολογική κλινική.

Αν και έγκαιρα και επανειλημμένα, έχουμε ενημερώσει όλους τους αρμόδιους φορείς (υπουργεία Υγείας, Δικαιοσύνης και Προστασίας του Πολίτη, διοικήσεις της 2ης ΥΠΕ και ΓΝΕ ΘΡΙΑΣΙΟ), δεν έχει κινηθεί καμία νομική διαδικασία για τους εμπλεκόμενους στις επιθέσεις σε βάρος συναδέλφων μας, με μοναδική εξαίρεση τον εμπλεκόμενο στις επιθέσεις στις 24 Ιουνίου 2022 και 24 Δεκεμβρίου 2021.

Οι αυξανόμενες επιθέσεις κάνουν επιτακτική την ανάγκη να εξασφαλιστεί, με κρατική ευθύνη,  πλήρης νομική κάλυψη και στήριξη στους υγειονομικούς, που δέχονται επίθεση κατά τη διάρκεια της εργασίας τους.

ΔΕΝ ΑΝΕΧΟΜΑΣΤΕ να κινδυνεύει η σωματική ακεραιότητα και η ζωή μας από επιθέσεις σε βάρος μας, κατά τη διάρκεια της εργασίας μας, γι΄αυτό απαιτούμε:

► να κινούνται ΑΜΕΣΑ οι αναγκαίες νομικές διαδικασίες για τους εμπλεκόμενους στις επιθέσεις και προπηλακισμούς σε βάρος υγειονομικών

► να εξασφαλίζεται πλήρης νομική στήριξη και κάλυψη στους εργαζόμενους, που δέχονται επίθεση κατά τη διάρκεια της εργασίας τους

► να ενισχυθεί η φύλαξη του ΘΡΙΑΣΙΟΥ νοσοκομείου, με πρόσληψη επιπλέον μόνιμων εργαζομένων. Να ανακληθεί η ανάθεση της φύλαξης σε ιδιωτική εταιρεία και οι εργολαβικοί και συμβασιούχοι φύλακες να προσληφθούν από το νοσοκομείο με μόνιμη σχέση εργασίας και πλήρη δικαιώματα.

► να ενισχυθεί ο φωτισμός του προαυλίου και του πάρκινγκ του ΘΡΙΑΣΙΟΥ νοσοκομείου καθώς και των περιμετρικών οδών

Σωματείο Μισθωτών Δικηγόρων: Στηρίζουμε τους δίκαιους αγώνες των συναδέλφων μας σε Αγγλία και Ουαλία

Το Σωματείο Μισθωτών Δικηγόρων εκφράζει την αλληλεγγύη του στους συναδέλφους δικηγόρους στην Αγγλία και στην Ουαλία, που απεργούν, διαμαρτυρόμενοι για τους χαμηλούς μισθούς και τους απάνθρωπους όρους εργασίας.

Συγκεκριμένα, απεργούν οι συνάδελφοι των ποινικών ακροατηρίων, που εκπροσωπούν κατηγορούμενους για ποινικά αδικήματα στο δικαστήριο. Οι συνάδελφοι μας απαιτούν να αυξηθούν οι αποζημιώσεις που λαμβάνουν από το κράτος για την παροχή νομικής βοήθειας.

Σύμφωνα με το βρετανικό σύστημα νομικής συνδρομής, η κυβέρνηση πληρώνει τους δικηγόρους των κατηγορουμένων που δεν έχουν την οικονομική δυνατότητα, για να διασφαλίσει ότι εκπροσωπούνται κατάλληλα, με βάση τις αρχές της δίκαιης δίκης.

Τα ποσοστά αμοιβής για τους δικηγόρους που παρέχουν έργο νομικής συνδρομής τα ορίζει η κυβέρνηση. Σε αυτό το πλαίσιο η Ντάουνινγκ Στριτ πρότεινε αύξηση μισθού κατά το 15%. Ωστόσο, οι δικηγόροι, ιδίως οι νέοι και ασκούμενοι, απορρίπτουν ως κοροϊδία την κυβερνητική πρόταση, λέγοντας ότι αποτελεί αύξηση – ψίχουλα. Όπως αναφέρουν, ένας νέος ή ασκούμενος δικηγόρος κερδίζει κατά μέσο όρο καθαρά μόλις 9.000 λίρες ετησίως (750 μηνιαίως), ενώ αν συνυπολογιστεί ο χρόνος που αφιερώνουν στην προετοιμασία των υποθέσεων, τότε οι ωριαίες αποδοχές τους είναι κάτω από τον κατώτατο μισθό.

Οι συνάδελφοι, σημειώνουν ότι η αύξηση κατά 15% που προτείνει η κυβέρνηση θα «εξαφανιστεί από τον πληθωρισμό» μέχρι να τεθεί σε ισχύ.

Χαιρετίζουμε τη μαζική συμμετοχή και την αποφασιστικότητα των συναδέλφων σε Αγγλία και Ουαλία να συνεχίσουν τις απεργιακές κινητοποιήσεις τους μέχρι να δικαιωθούν.

Οι συνάδελφοι μας έχουν ήδη ανακοινώσει ότι οι απεργίες θα διαρκέσουν τέσσερις εβδομάδες. Αυτή την εβδομάδα θα γίνουν απεργίες τη Δευτέρα και την Τρίτη, ενώ οι ημέρες απεργίας θα αυξάνονται κατά μία κάθε εβδομάδα μέχρι μια πενθήμερη απεργία από τη Δευτέρα 18 Ιούλη έως την Παρασκευή 22 Ιούλη. Αν δεν ικανοποιηθούν τα αιτήματά τους, προειδοποιούν ότι θα συνεχίσουν και τον Αύγουστο!

Η εξέλιξη αυτή αποδεικνύει ότι η εκμετάλλευση μισθωτών και ασκούμενων δικηγόρων, δεν είναι μόνο «ελληνικό φαινόμενο» ούτε μόνο γνώρισμα της ελληνικής οικονομίας. Επιβεβαιώνει ότι τόσο στην Ελλάδα, όσο και στο Ηνωμένο Βασίλειο, οι μισθωτοί και ασκούμενοι δικηγόροι είμαστε εργαζόμενοι και όχι «συνεργάτες». Βιώνουμε την εκμετάλλευση γιατί αναγκαζόμαστε τις επιστημονικές μας γνώσεις στους εργοδότες (μεγάλες δικηγορικές εταιρείες και γραφεία, τράπεζες και άλλες επιχειρήσεις) για να ζήσουμε. Ανεξάρτητα από το νομικό χαρακτηρισμό που αποδίδεται στις εργασιακές σχέσεις μας, υπαγόμαστε στις εντολές του εργοδότη σχετικά με τον τόπο, τον τρόπο και χρόνο παροχής εργασίας, υπαγόμαστε διαρκώς σε διαδικασίες αξιολόγησης για να γινόμαστε πιο αποδοτικοί.

Αποδεικνύεται ότι η μισθωτή δικηγορία δεν έχει καμία σχέση με όσα μας «δίδασκαν» οι καθηγητές στο πανεπιστήμιο, με όσα μας τάζουν οι εργοδότες μας, ούτε είναι «επεισόδιο» στη γνωστή τηλεοπτική σειρά «Suits».

Αξίζει να σημειωθεί ότι σε χώρες όπως η Αγγλία και η Ουαλία, εδώ και πολλά χρόνια έχει προωθηθεί η απελευθέρωση του δικηγορικού επαγγέλματος, ο διαχωρισμός των δικηγόρων σε δικηγόρους 2 ταχυτήτων και η επέκταση των λεγόμενων «παρα-νομικών» επαγγελμάτων. Αντίστοιχα, και στη χώρα μας είναι σταθερή επιδίωξη η υλοποίηση κατευθύνσεων της ΕΕ, για να αυστηροποιηθούν οι εξετάσεις για την άδεια ασκήσεως επαγγέλματος, διαμορφωθεί μια νέα στρατιά αποφοίτων με μειωμένα επαγγελματικά προσόντα και δικαιώματα, ως ένα νέο φθηνό και «ευέλικτο» επιστημονικό δυναμικό που θα απασχολείται στις μεγάλες δικηγορικές εταιρείες και σε άλλες επιχειρήσεις, ακόμα και με τη μορφή των λεγόμενων «παρα-νομικών» επαγγελμάτων.

Αποδεικνύεται ότι οι επιδιώξεις αυτές συμβάλλουν στην ένταση της επίθεσης στα δικαιώματα μας, για μισθό σύμφωνα με τις σύγχρονες ανάγκες, ανθρώπινο ωράριο, κάλυψη ασφαλιστικών εισφορών, άδειες, επιδόματα, αποζημίωση σε περίπτωση απόλυσης.

Στηρίζουμε έμπρακτα τους αγώνες των συναδέλφων μας σε Αγγλία και Ουαλία. 

Και η περίπτωση τους αναδεικνύει την άμεση και επιτακτική ανάγκη να παλέψουμε τώρα για υπογραφή Συλλογικής Σύμβασης Εργασίας που θα είναι υποχρεωτική για όλους τους εργαζόμενους μισθωτούς δικηγόρους, για σταθερή και μόνιμη δουλειά, ενάντια στις ελαστικές σχέσεις εργασίας, στην επιβολή δυσμενών συνθηκών εργασίας, στην εντατικοποίηση της εργασίας, ανεξάρτητα από το νομικό χαρακτηρισμό που αποδίδεται σε αυτές από τον εκάστοτε εργοδότη. Σε αυτήν την κατεύθυνση δεσμευόμαστε ότι θα δώσουμε όλες μας τις δυνάμεις.

 

Πανελλήνιος Σύλλογ. Συνταξιούχων πρώην ΔΕΚΟ Τραπεζών : Απαιτούμε την απόδοση όλων των αναδρομικών σε όλους τους δικαιούχους

Προκαλώντας για άλλη μια φορά εκατοντάδες χιλιάδες συνταξιούχους η κυβέρνηση αρνείται να αποδώσει τα δικαιούμενα αναδρομικά των κλεμμένων δώρων και επιδομάτων άδειας των  συντάξεων σε όλους τους δικαιούχους, κλοπή που ο νόμος Κατρούγκαλου της κυβέρνησης ΣΥΡΙΖΑ- ΑΝΕΛ επισφράγισε οριστικά.

Επαναλαμβάνοντας την επιχείρηση εξαπάτησης των συνταξιούχων, όπως το 2020, η κυβέρνηση, κρυπτόμενη πίσω από την πρόσφατη απόφαση του ΣτΕ και τη μόνιμη πλέον δικαιολογία περί «δημοσιονομικών αντοχών», επανέρχεται και αποφασίζει να αποδώσει τα αναδρομικά δώρων και επιδομάτων αδείας κύριων και επικουρικών συντάξεων του 11μηνου 6/2015 έως 5/2016, μόνο σε όσους προσέφυγαν στα δικαστήρια μέχρι 31.7.2020 (ψήφιση ν. 4714/2020- περίπου 350.000), όταν οι δικαιούχοι υπερβαίνουν τα δύο εκατ/ρια. Όμως με την προϋπόθεση πως οι δικαστικές προσφυγές θα δικαιωθούν στα δικαστήρια! Διαδικασίες που για δεκάδες χιλιάδες συναδέλφους μπορεί να σέρνονται για μερικά ακόμα χρόνια!!

Μάλιστα το ΣτΕ νομιμοποιεί την επιλογή της κυβέρνησης να δώσει τα αναδρομικά μόνο των κύριων συντάξεων, επιλογή που προσέκρουε και παραβίαζε την προηγούμενη απόφαση του ΣτΕ για απόδοση όλων των παρακρατηθέντων του 11μηνου. Όταν μάλιστα η ίδια αυτή κυβέρνηση, στις συναντήσεις με αντιπροσωπείες της ΣΕΑ, επίσημα δεσμευόταν πως με πολιτική απόφαση θα τα αποδώσει όλα σε όλους και καλούσε τους συνταξιούχους να απέχουν από δικαστικές προσφυγές!!

Επιβεβαιώνεται και πάλι η θέση του αγωνιστικού συνταξιουχικού κινήματος πως οι κυβερνήσεις του κεφαλαίου, όταν πρόκειται να ικανοποιήσουν λαϊκά αιτήματα, βρίσκουν σωρό δικαιολογίες για να μην το κάνουν, αλλά όταν αφορά στα συμφέροντα των μεγαλοκαπιταλιστών, τότε οι δικαιολογίες επιστρατεύονται ακριβώς για να τους δοθούν όλα.

Η κυβέρνηση είναι έκθετη στα μάτια χιλιάδων συνταξιούχων, που δεν πρόκειται να ξεχάσουν αυτή την προκλητική και άδικη συμπεριφορά.

Καταγγέλλουμε την κυβερνητική μεθόδευση και απαιτούμε την απόδοση όλων των αναδρομικών σε όλους τους δικαιούχους, ανεξάρτητα από δικαστικές αποφάσεις.

Ομοσπονδία Ενώσεων Νοσοκομειακών Γιατρών Ελλάδας: Για ιατρικό μισθολόγιο

Οι διατάξεις του Ν. 4093/2012 με τις οποίες είχαν μειωθεί δραστικά οι τακτικές αποδοχές των νοσοκομειακων γιατρών, έχουν κριθεί αντισυνταγματικές με απόφαση του ΣτΕ 26/2/2018 κατόπιν προσφυγής της ΟΕΝΓΕ.

Τόσο η σημερινή κυβέρνηση της ΝΔ όσο και η προηγούμενη κυβέρνηση του ΣΥΡΙΖΑ, αρνούνται προκλητικά να εφαρμόσουν αυτή τη δικαστική απόφαση ως σήμερα.

Ως ΟΕΝΓΕ είχαμε προσφύγει και στην Επιτροπή Συμμόρφωσης του ΣτΕ προκειμένου να εφαρμοστεί η δικαστική απόφαση.  Η τότε πρόεδρος του ΣτΕ και νυν Πρόεδρος της Δημοκρατίας κ. Σακελλαροπούλου είχε αποφανθεί ότι για να συμμορφωθεί η πολιτεία θα έπρεπε πρώτα να κριθούν αντισυνταγματικές από το ΣτΕ και οι διατάξεις του Ν. 4472/2017 που καθορίζουν το ισχύον σημερινό μισθολόγιο των νοσοκομειακών γιατρών και οι οποίες φυσικά δεν είχαν «διορθώσει» τις περικοπές του 2012.

Χθες, 28/6/22, η ολομέλεια του ΣτΕ έκρινε αντισυνταγματικές και αυτές τις διατάξεις του Ν. 4472/2017.

Πλέον δεν υπάρχει καμία, έστω και προσχηματική, δικαιολογία για ένα κράτος το οποίο όποτε το συμφέρει κραδαίνει τη σημαία του «σεβασμού στις δικαστικές αποφάσεις» και όποτε το συμφέρει τις παραβιάζει το ίδιο προκλητικά.

Οι μισθοί των νοσοκομειακών γιατρών θα πρέπει να επανέλθουν άμεσα στα επίπεδα του Ιανουαρίου του 2012 πριν τις μνημονιακές περικοπές.

Επίσης απαιτούμε και διεκδικούμε την:

  • Επαναφορά των συντάξεων και του εφάπαξ στα επίπεδα πριν από όλες τις μνημονιακές περικοπές.
  • Αυτοτελή φορολόγηση των τακτικών εφημεριών χωρίς προσμέτρησή τους στο φορολογητέο εισόδημα. Αφορολόγητο για τις  πρόσθετες («πέραν του πλαφόν») εφημερίες.

Συνεχίζουμε και κλιμακώνουμε τον αγώνα για μισθολογική, επιστημονική και εργασιακή αξιοπρέπεια. Διεκδικούμε την υπογραφή νέας Κλαδικής Σύμβασης.
